Football Season is Almost Upon Us
Football season is almost upon us. How does this impact your association... probably very little BUT:
-
Does your Association have a restriction on displaying signs or flags? If so, do the rules violate free speech protections? For Washington associations, do the rules comply with the Freedom to Display the American Flag Act of 2005? For Washington homeowner associations, do they comply with RCW 64.38.033 and .034? Remember, an owner may be "offended" by their neighbor's Duck flag or 49er sign but if the Association goes after those owners and leaves the 12's alone, they're asking for trouble.
-
Does your Association have standards for the installation of satellite dishes or antennas? If so, do they comply with FCC rules? Some standards are allowed, particularly if the Association allows installation on areas that are not for exclusive use by the owner. Get between a fan and the big game, and they may bring the FCC into their corner.
-
Are there community restrictions regarding parking? Those watch parties sometimes bring more vehicles than there are parking spaces available.
-
Does your Association have common areas where people gather to watch a game? Can it be reserved or rented? If so, do you have rules and requirements regarding alcoholic beverages? Those vehicles illegally parked outside shouldn't be driven by someone under the influence.
If you would like your association's rules and regulations reviewed for compliance, please give us a call.
